TERMS AND REFUND POLICY

The short version. Before your kit ships, you get a full refund. Once it ships, the kit cost is yours. Through the end of week two you can leave and get half your tuition back, no explanation needed. After week two, no refunds. The course materials are yours to use, not to share or teach from.

1. WHO YOU ARE CONTRACTING WITH

KanbanVibe is operated by Optimal WIP LLC, a Utah limited liability company located at 826 Expressway Ln Unit #788, Spanish Fork, UT 84660 ("we," "us," "KanbanVibe"). These Terms govern your purchase of and participation in the KanbanVibe Focus Room (the "Program") and your use of kanbanvibe.com.

By registering, you agree to these Terms. If you do not agree, do not register.

2. WHAT YOU ARE BUYING

A seat in the KanbanVibe Focus Room, a six-week live online group program. A seat includes:

A seat is personal to the enrolled participant and may not be shared, resold, or transferred to another person without our written consent.

One-to-one add-on

A limited number of one-to-one places are available to participants in the College and Adults cohort. A one-to-one place includes everything in a standard seat plus six scheduled private sessions of approximately 45 minutes each. Private session times are arranged with you after registration and are subject to mutual availability. One-to-one places are not offered to participants under 18.

If a private session is missed without at least 24 hours notice, that session is treated as delivered. If we miss or move a private session, it is rescheduled at no charge.

3. ENROLLMENT AND PARTICIPANTS UNDER 18

If the participant is under 18, a parent or legal guardian must complete the registration, is the contracting party under these Terms, and is responsible for payment and for the participant's conduct.

After registration, the parent or guardian will be asked to complete a short intake form and to provide written consent covering participation, video attendance, and recording. We may decline or cancel an enrollment if that consent is not provided.

A participant under 18 may not attend the first session until the parent or guardian consent form has been received. If it has not been received before the cohort begins, we will cancel the enrollment and refund it in full rather than allow attendance without consent on file.

We do not knowingly enroll a participant under 13. See our Privacy Policy for how we handle information about minors, and our teen safety page for how the room is run.

4. PAYMENT AND PAYMENT PLANS

Prices are in U.S. dollars. Payments are processed by Stripe; we do not receive or store your full card number. Applicable sales tax, if any, is added at checkout.

The founding rate is available for registrations completed on or before the published founding-rate deadline. After that date the standard rate applies. The founding rate is not a limited-time discount off a future price; it is a lower rate offered to the first cohorts.

Two-payment plan

If you choose the two-payment option, the first payment is a deposit due at registration and the balance is due the week your cohort begins. Your seat and your access to recordings may be suspended if the second payment is not received. Choosing the payment plan does not change the refund schedule below, and amounts already paid are refunded according to that schedule.

5. REFUND POLICY

We ship your kit as soon as you register, because having the materials in hand before the program starts is part of how it works. That means our costs are incurred early, which is why the schedule below is structured the way it is.

One-to-one add-on refunds

If you purchased a one-to-one place, the group portion follows the schedule above. The private-session portion is refunded pro rata for sessions not yet delivered, calculated as the difference between the one-to-one price and the standard seat price, divided by six, for each private session remaining. Once the window in the final row above has closed, no further refund is available on either portion.

How to request a refund

Email refund [at] kanbanvibe.com from the address used at registration. The date we receive your email is the date used to apply the schedule above. Approved refunds are issued to the original payment method within 10 business days.

Transfers instead of refunds

You may transfer your seat once to a later cohort at no charge if you request it before session three. Transfers are subject to seat availability. A transferred seat carries the rate you originally paid, and you keep your original kit.

What is not refundable

Missed sessions and inactivity

Failing to attend does not cancel your enrollment or entitle you to a refund. If you stop attending without contacting us, your enrollment continues and the schedule above still applies.

6. SCHEDULE CHANGES AND CANCELLATION BY US

We may move an individual session date when circumstances require it, including when a significant portion of the cohort has a conflict such as a school break. We will give as much notice as we reasonably can.

If we cancel a cohort before it begins, you receive a full refund including any materials fee, and you keep your kit. If we cancel a cohort after it has begun, you receive a pro-rated refund for the sessions not delivered.

Minimum enrollment: we may postpone a cohort that does not reach a workable group size, in which case you may transfer to the next cohort or take a full refund.

7. YOUR KIT

Kits ship to U.S. addresses. You are responsible for providing an accurate shipping address; we are not responsible for kits delivered to an address you entered incorrectly. If your kit arrives damaged or incomplete, contact us within 14 days of delivery and we will replace the affected items.

Risk of loss passes to you on delivery to the carrier. Kits are not returnable.

8. INTELLECTUAL PROPERTY AND YOUR LICENSE

KANBANVIBE and KANBANVIBE FOCUS ROOM are trademarks of Optimal WIP LLC. Nothing in these Terms grants you any right to use them.

All program content is owned by Optimal WIP LLC or its licensors. This includes the cohort workbook and every worksheet, assessment, template, and exercise in it; the laminated reference cards; slides and visual materials; session recordings; and the structure, sequence, and pedagogical arrangement of the program itself.

The book Work in Progress: How Limiting What You Do Helps You Do More is a separate copyrighted work, also owned by Optimal WIP LLC. It is not included with a seat and is not licensed by these Terms. Purchasing a seat gives you no rights in the book, and purchasing the book gives you no rights in the program materials. The cohort workbook is a derivative work of the book, and both are protected independently.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the materials for your own personal, non-commercial use. You may photocopy or reprint worksheets from your workbook for your own repeated personal use, or for use within your immediate household.

You may not:

To be clear about what you can do: everything you build is yours. Your board, your cards, your system, your notes, photos of your own board, and anything you make using what you learn are entirely yours, including for commercial purposes. What is restricted is redistributing our materials or repackaging the program itself.

The cohort workbook, reference cards, and program outline are provided to enrolled participants only and are not published or offered for public sale. You agree to treat them as confidential and not to make them available to anyone outside your household.

Kanban as a method is not ours and never has been. Nothing here restricts your use of kanban itself, of publicly available writing about it, or of anything in the published book beyond ordinary copyright. These restrictions cover our specific materials and the program, not the underlying practice.

What happens if you leave or take a refund

Your license ends if your enrollment is refunded, transferred away, or terminated. Your access to recordings and any digital materials ends on the same date.

You may keep the physical kit and workbook you received, and you may keep using them for your own personal, non-commercial purposes. The restrictions in this Section 8 and in Section 9 continue to apply to those materials permanently, whether or not you remain enrolled and whether or not you received a refund. Taking a refund does not release you from them. Receiving a partial refund while keeping the workbook does not convert the workbook into an unrestricted work, and does not grant any right to reproduce, distribute, or teach from it.

9. RECORDINGS AND CONFIDENTIALITY

Live sessions are recorded and shared with the enrolled participants of that cohort so anyone who misses a week can catch up. By attending, you consent to being recorded. If the participant is under 18, the parent or guardian consents on their behalf at intake.

You can attend with your camera off if you prefer not to appear on the recording, though cameras-on participation is a core part of how the program works.

We will not use a recording that identifies a participant for marketing or promotion without that participant's separate written permission, and for a participant under 18, the written permission of a parent or guardian.

Stories, quotes, and case studies

The clause above covers recordings. This one covers everything else: written case studies, quotes, testimonials, endorsements, examples in a book or article, and anything else drawn from your participation, whether it came from a recording, a transcript, a session note, an email, or a conversation.

We will not publish any of it in a form that identifies you without your separate, specific, written permission. Permission is opt-in, is never a condition of taking part, and is requested apart from these Terms so that declining costs you nothing. We will show you the exact wording before it is published, and you may withdraw permission at any time.

When you withdraw, we will remove the material from anything we control and can change: our website, our emails, our social accounts, and any future edition, printing, or reprint of a book or other fixed work. What we cannot do is recall copies already printed and sold, or content already distributed by a retailer or third party. So that the stakes are clear before you decide, anything appearing in a printed book is permanent in the copies already in circulation, and we will tell you plainly at the time we ask whether a use is a fixed one.

Fully de-identified and aggregated observations are different, and we may use those freely. "Most people set their first WIP limit too high" is an observation about a cohort. "A ninth grader in our fall room" is not, if the group is small enough that it points at someone.

Participants under 18. A student under 18 never appears in a photograph, video clip, or recording used publicly, with or without permission. Written material only, first name and grade at most, and only where a parent or guardian has opted in in writing and the student has agreed.

What other participants share in the room stays in the room. Do not repeat, post, or share another participant's personal information, board contents, or anything they disclose during a session.

No AI notetakers, meeting assistants, or bots

You may not connect, invite, or run any third-party tool that joins, listens to, records, transcribes, captions, or summarizes a session. This covers AI meeting assistants and notetaker bots, transcription and summarization services, and any application capturing session audio, video, or chat, whether it appears in the room as a participant or runs quietly on your own device.

There are two reasons, and both matter.

The first is ownership. The program materials and the discussion around them are ours, and a tool that transcribes a session copies that content to a company that is not a party to these Terms and whose retention and training practices we have no control over.

The second is the other people in the room. Everyone in a session agreed to be recorded by us, on the terms set out above. Nobody agreed to have their words, face, or circumstances processed and stored by a vendor they did not choose and cannot ask to delete their data. That is doubly true in the teen cohort, where the participants are minors and their parents consented to one recording arrangement, not an open-ended set of them.

If a notetaker or bot appears in a session we will remove it. If it happens again we will remove the participant who brought it, under Section 10, without refund.

You do not need one. Every session is recorded and shared with your cohort, so you can rewatch any part of any week.

Accessibility. If you need live captions, the video platform's own captioning works and keeps session content inside the platform we already use. Ask and we will enable it. This clause is about third-party tools, never about the accommodations someone needs to take part.

10. CONDUCT IN THE ROOM

The room works because it is safe. Harassment, abuse, discriminatory conduct, disclosure of another participant's private information, repeated use of prohibited recording or AI tools as described in Section 9, or persistent disruption may result in removal from the program without refund.

11. NOT MEDICAL, PSYCHOLOGICAL, OR EDUCATIONAL ADVICE

The KanbanVibe Focus Room is an educational program about a productivity method. It is not medical care, psychotherapy, counseling, diagnosis, treatment, or special education services, and it is not a substitute for any of them. We are not licensed healthcare providers, and no clinician-patient or therapist-client relationship is created.

Nothing in the program should be used to make decisions about medication, treatment, or clinical care. Always consult a qualified professional for those.

We make no guarantee of any particular result. Individual outcomes depend on individual circumstances and effort.

12. DISCLAIMERS AND LIMITATION OF LIABILITY

The program and materials are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, our total liability arising out of or relating to these Terms or the program will not exceed the amount you actually paid us for the program. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

13. GENERAL TERMS

Changes to these Terms

We may update these Terms. The version in effect on the date you registered governs your enrollment. Changes apply to registrations made after the updated date shown at the top of this page.

Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Utah County, Utah, and you consent to that jurisdiction.

Survival

Sections 8 (Intellectual property), 9 (Recordings and confidentiality), 11 (Not medical, psychological, or educational advice), 12 (Disclaimers and limitation of liability), and this Section 13 survive the end of your enrollment for any reason, including refund, transfer, completion, or termination.

Severability

If any provision is held unenforceable, the rest remains in effect.

Entire agreement

These Terms, together with our Privacy Policy, are the entire agreement between us regarding the program.
